COIDA ROE MINIMUM ASSESSMENT AMOUNT
It is important that employers note the following:

Return of Earnings (ROE) minimum assessment amount

In terms of Section 83(1) of the Compensation for Occupational Injuries and Diseases Act, the Director-General of Employment and Labour has issued a notice to increase the minimum assessment amount to R1 284.

The notice was issued through Government Gazette No. 44422 of 7 April 2021.

The minimum assessment ensures that the assessment is not less than the administration costs.

The department also announced the withdrawal of the implementation of Section 85 (1) on reductions with effect from 1 March 2021 until further notice.

Section 85 (1) allowed for a variation in the tariff of assessment based on an employer taking steps to prevent accidents as compared to employers in like businesses.

COIDA REVISED RETURN OF EARNINGS (ROE) FORM
It is important that employers note the following:

COIDA Return of Earnings (ROE) form revised
A revised return of earnings form (W.As.8) for the year of assessment 1 March 2021 to 28 February 2022, in terms of the Compensation for Occupational Injuries and Diseases Act, has been drawn up and published on 19 March 2021 in Government Gazette 44302.


The previous form has been repealed with immediate effect.

The new W.As.8 form contains the prescribed maximum earnings amount applicable to provisional earnings which increased from R484 200 per annum to R506 473 per annum, as announced in Government Gazette 44238 Notice 184 of 2021 on 5 March 2021.

Employers are still encouraged to file the return online on the website of the Department of Employment and Labour.

COIDA MANNER OF CALCULATING COMPENSATION
It is important that employers note the following:

COID Act Schedule 4: Manner of calculating compensation
Government Gazette 44238 Notice 184 of 2021 was published on 5 March 2021 by the Department of Employment and Labour to inform all interested parties of the intention to amend Schedule 4 of the COID Act for accidents that occur from 1 April 2021, as well as occupational diseases diagnosed from 1 April 2021.

Interested parties are invited to submit comments by email to Melinda.Visagie@labour.gov.za within 60 days of the publishing of this notice.

The intention is to amend the minimum and maximum compensation amounts, effective 1 April 2021, as follows:

COIDA MAXIMUM AMOUNT OF ASSESSMENT
It is important that employers note the following:

COIDA maximum amount of assessment increased

Government Gazette 44238 Notice 184 of 2021 was published on 5 March 2021 by the Department of Employment and Labour and announces the maximum amount of earnings on which the assessment of an employer will be calculated. The effective date is 1 March 2021.

The prescribed amount under Section 83(8) of the Compensation for Occupational Injuries and Diseases Act No 130 of 1993 (COIDA) has been increased to R506 473.00 per employee per annum.

Currently, the maximum amount of earnings is R484 200 per annum.
